Audio Pro Privacy Policy

We take your privacy very seriously and are committed to implementing and complying with the data protection principles and the Personal Data (Privacy) Ordinance ("the Ordinance"). Audio Pro ("we") is a Neos Education Limited company and is responsible for processing data relating to Audio Pro consumer and professional electronics products, services and Hong Kong websites.
This Policy explains the types of information we may collect and store, how that information is used and with whom it may be shared (see the Transfer of Personal Information section). It also sets out how you can contact us if you have any questions or concerns about this material. Some of our services also have specific privacy policies, which provide detailed information about how your information is used by that service.
This Privacy Policy applies to you when you:
• Visit our website https://www.audioproneos.com.hk/;
• Create, use and manage your My Audio Pro membership (My Audio Pro Account);
• Purchase from our physical store or online store;
• Contact our customer service and request our customer support;
• Participate in our events such as competitions, roadshows, seminars, workshops or promotions;
• use of mobile phone applications of our related companies;
• visit or contact us on our social media pages such as Facebook, Instagram or WhatsApp Business; or
• Any other time we collect and process your personal data.
1. Personal Data We Collect and/or Store
It is optional for you to provide your personal data. However, if you do not provide the requested information, we may not be able to provide you with the products or services you have requested.
Information you provide to us
Whenever you interact with us, you may be asked to provide us with information about yourself. For example:
• Some of our Services require you to create an account, such as the My Audio Pro membership at https://www.audioproneos.com/. When creating or using your Audio Pro membership, we may ask you to provide a range of information such as your name, contact details, age group, gender, birth month, interests, account and newsletter preferences, purchase details, purchase location, product registration;
•When you join one of our loyalty schemes, we may collect information about your use of the loyalty scheme and the rewards you claim;
• When you purchase or pre-order products from our store, we may record calls and/or ask you to provide information such as your contact details, purchase details, delivery date, visit and pre-order time, interest in and place of purchase of Audio Pro store products and payment details;
• When you contact our customer service for assistance via email, phone, web chat, WhatsApp, Facebook, Instagram or other means, we may retain information about the call and record it, including your name, phone number, email, inquiry details, the products you purchased, the reason you contacted us, the advice we gave you and we may record the content of your call to monitor the quality of our customer service and marketing;
• When you contact our customer service for installation, repair or return, prize redemption or otherwise seek our customer support, we may retain your contact information, product repair information, prize redemption information, purchase location and your purchase invoice;
• When you enter one of our prize draws or competitions, we may collect your contact details, address, age group or material you submit;
• When you are at a public event such as a competition, roadshow, exhibition or seminar, workshop or participate in one of our surveys or redemption campaigns, we may collect your contact details, survey data, interests, age, gender, redemption campaign data;
• When you use our online services, we may receive content that you choose to upload, such as product reviews, comments, photos and forum posts, or when you choose to tell us details about your interests and preferences, for example, to select the services you would like to receive.
Information We May Collect from Other Sources
We may also collect information from publicly available sources and third parties, including:
• When you attempt to buy from us, we may carry out credit and financial checks to ensure that the payment is not fraudulent and that you have a suitable credit rating;
• If you purchase products or services from an Audio Pro store or other retailer, we may receive certain information about your purchase from that retailer.
• When conducting business-to-business sales calls, we may use publicly available business contact information.
Information we may collect in connection with social networks
If you use any of our social network applications, pages or plug-ins, or if you use one of our products or services that allow interaction with a social network, we may receive data associated with your social network account.
For example, if you log in to one of our websites or services using your social network account, we may receive basic information from your social network profile. The basic information we receive may depend on your social network account privacy settings, however, they may include your social network ID, name, profile picture, gender and locale. If you allow us to access it, we may also receive other information from your personal data.

Information We May Collect When You Use Audio Pro's Websites, Products and Services.
Some of our websites, Internet-enabled products and online services provide us with information about your use of them, including:
• Details of the content you view and interact with. For example, when you use our website, we may collect information about your browsing, such as your browser software, the pages you view, and the items you "click" on or add to your shopping cart.
• Service, product or server logs, which contain information about your use of our services, products or websites, such as your IP address, browser information (including HTTP user agent string), HTTP client request information, and the time and location of your activities, domains, device and application settings, errors and hardware activity
• Device information, such as your device ID and/or information about the physical location of your device. For example, when you use a geolocation service or application and agree to share your location
• interests and preferences that you specify during the setup of Internet-enabled products or services;
• Email communications between you and our customer service or other Audio Pro personnel may be managed and recorded;
Typically, this information is collected using a digital identifier, such as a device number, browser cookies, or your IP address. These identifiers are used to distinguish the information provided by your browser or device from that provided by other users' browsers or devices.
We may associate the information we collect with one of your accounts, for example, if you are logged into a service when the information is collected.
2. Purpose of Data Collection and Use
We may use your personal data collected and stored for the following purposes:
Provide products and services
(a) provide you with the products or services you request (whether from our Audio Pro Store or Online Store, including any product or service updates) and check that payments have not been made fraudulently and deliver your purchase to you or ensure that you benefit from any relevant special offers or promotions (and carry out its obligations under any other agreement it may have with you);
(b) provide customer support (whether in person, in one of our Audio Pro stores, online, by telephone, email, social media, WhatsApp or otherwise);
(c) provide customer support, installation, warranty, repair, returns and other after-sales services;
(d) organise and host our events, competitions, roadshows, seminars, workshops and participate in our redemption activities;
(e) establish and maintain your Audio Pro account, including creating and maintaining your My Audio Pro membership;
(f) To provide our checkout assistance services. When you use our online store, information about any products you attempt to purchase and your email address may be collected when you fill out the checkout form. If you do not complete your purchase, we may use this information to contact you to provide our assistance (for example, if you experience technical problems);
Product and service development;
(g) Continuously improve our products and services to better meet customer requirements, ensure data quality, develop identity management, and enhance network and data security. In these circumstances, we may use personal data:
• For staff training and quality assurance purposes, particularly with respect to our customer relations staff via telephone, email and other support centres;
• measure our performance or solicit your opinions about Audio Pro’s products and services and conduct product surveys;
• Develop and improve new and existing Audio Pro products and services, recommendations, advertising and other communications, and to learn more about our customers’ overall shopping preferences;
(h) conduct sweepstakes, contests and other promotions;
(i) post messages or answer surveys to our social media, internet platforms or any other means;
(j) Customize our Services according to your needs – Information about the use of the Services may be used to compile aggregate statistics and perform analysis to help us create content and browsing items that are most relevant and user-friendly to our users;
(k) perform analytics to better target and provide personalized content, recommendations or advertising within any Audio Pro service or application you use;
(l) (with your consent - see the Direct Marketing section below) conduct direct marketing, including but not limited to the promotion, marketing or sale of Audio Pro’s electronics and related products and/or services and communicating with members, including contacting you directly to inform you of new services or opportunities;
other
(m) investigate and resolve claims and disputes and detect and prevent fraud (whether or not related to the products and services we provide); and(n) any other purpose directly related to any of the above.
While we strive to adhere to our strictest guidelines and select only reputable partners to provide services, our privacy protection does not include personal data you provide directly to third parties (including but not limited to buyers/sellers in online auctions, online merchant websites, other hyperlinked websites). We recommend that you consult with the relevant party before providing any personal data.
3. Transmission of Personal Data
You acknowledge and authorize that your personal data will be retained by us and stored in one or more of our databases. We will fully control and protect your personal data in accordance with strict security and confidentiality standards, but may share your personal data with the following individuals and/or entities, whether within or outside Hong Kong, for any of the purposes set out above:
(a) any agents, contractors or third party service providers who provide services to us, including analytical and processing, administrative, accounting, customer service, data hosting, logistics, delivery and fulfilment, installation, fraud detection, telecommunications, computer, payment processing, marketing, insurance, financing, legal and other professional services;
(b) provide us with credit reference or debt collection agencies or similar debt collection or credit reference service providers for credit reporting, verification and risk management purposes;
(c) third party advertising partners so that they can better target and/or personalize the advertisements displayed within any Audio Pro Service or any application you use (whether Audio Pro’s or not);
(d) third parties (including professional advisors) to enforce or defend any Audio Pro’s legal rights or the terms and conditions of any Audio Pro products or services;
(e) any person or authority to whom we are obliged to disclose information under any law, regulation, rule, code of practice or guideline that is binding on or applicable to us;(f) any other person who is under a duty of confidentiality to us and has undertaken to keep such information confidential;
(g) any actual or proposed assignee of ours or a transferee of our rights in the event of our reconstruction, reorganization or other similar event.
(h) persons with whom you transact through our Services, such as online merchants, any banking, financial or other institutions.
4. Direct Marketing
Where we intend to use and transfer your personal data for direct marketing purposes as required by the Regulation, we will not do so unless we have your consent or written consent (in the case of such transfer).
With your prior consent or written consent (where transmitted) (including an indication of no objection), we may:
(a) use personal data including your name, contact details (including email, phone number, WhatsApp and address) for direct marketing purposes;
(b) Direct marketing of our products and services:
i) electrical and electronic products and related products, accessories and services;
ii) telecommunications products and related products, accessories and services;
iii) rewards, loyalty, co-branded or privilege programmes and related services, such as My Audio Pro membership;
(c) provide the personal data referred to in (a) to any agent or contractor for the purpose of directly marketing the above products and/or services on our behalf; and
(d) in addition to marketing the above products and services, share the personal data described in (a) with any third party suppliers of any category of products and/or services described in (b) for direct marketing related to such products and/or services, and we need your written consent (including an indication of no objection) and we will not do so without your written consent.If you do not consent to us using and/or sharing your personal data for any of the above purposes, we will not conduct direct marketing to you or provide your personal data to others for direct marketing purposes. You may also withdraw your consent subsequently by writing to our Personal Data Protection Officer (address below). If you exercise your right to opt-out from the use/sharing of your personal data for any of the purposes listed above, this will mean that we, our group companies and/or third party service providers will not be able to send you any direct marketing, targeting or special offers. If you exercise your right to opt-out of direct marketing, we will cease using and transferring your personal data for direct marketing purposes at no charge to you.
5. Use of “cookies” to collect data
What are "cookies"?
We may use "cookies" to collect data about users' use of our Services and to facilitate return visits. A "cookie" is a small piece of information sent by a web server and stored on a web browser so that it can be read back from that browser at a later time. Data collected from cookies is currently used to improve the functionality of our services. Data about our Services is organized and presented based on our analysis of aggregate usage of our Services. Cookies are also useful in allowing more streamlined logins, tracking transactions, and saving data between sessions.
6. Security
We are concerned about the security of personal data we collect from you and have implemented measures to prevent unauthorized access to that information. Our systems protect electronic communications by using appropriate security protocols for authentication and authorization, including SSL, encryption, firewalls, and data replication.
To help protect you and others, we monitor use of Audio Pro Assets to: identify fraudulent activity and transactions; prevent misuse and investigate and/or prosecute any potential threats to or misuse of Audio Pro Assets; ensure compliance with applicable Terms of Service and User Agreements and this Privacy Policy; investigate violations of or enforce those agreements; and protect the rights and assets of Audio Pro, its partners, and customers.
Surveillance may result in the collection, recording, and analysis of online activities or communications through Audio Pro Assets. If you do not agree to these conditions, you must cease using the Audio Pro Assets.
7. Retention Period
We will retain your personal data as needed for the purposes set out in this Privacy Policy or as otherwise agreed between you and us, unless otherwise required or permitted by applicable law. When we no longer need your personal information for the purposes described in this privacy policy or as required by law, we will take appropriate steps to securely delete or destroy your personal information.
8. Updates to our Privacy Policy
We take our users' privacy concerns seriously and recognize the need to update this policy as we offer new features and business services, and may update our privacy policy from time to time. We will notify users of any significant changes to the Privacy Policy prior to the date of the change. We encourage you to review our updated Privacy Policy from time to time. Your continued use of our products and services will be deemed as your acceptance of our updated privacy policy.
9. Other Rights
Nothing in this Privacy Policy shall limit the rights of any person under the Ordinance. Under the Ordinance, you have the right to:
(a) check whether we hold your personal data;
(b) request access to your personal data held by us;
(c) request correction of your personal data;
(d) determine from time to time our policies and practices regarding the personal data and types of personal data we hold;
We reserve the right to charge a reasonable fee for the time and attendance involved in complying with any request in this regard.

Please note that under section 19(1) of the Ordinance, a data access request will be completed within 40 days of receipt of the request form. If the request cannot be complied with or there are good reasons for refusing to comply with it, you will be notified of such matters within the same 40 days under section 19(2) or 21(1) of the Regulations.
